Restoration of Gun Rights Before the Psychiatric Security Review Board (PSRB)

Only a handful of these types of restorations have come before the Psychiatric Security Review Board (PSRB) and our law firm has handled the vast majority of them (if not all).

There are situations where someone is prohibited from being able to purchase or possess a firearm because they were found to be legally insane by a court, hospitalized for psychiatric episode or placed on a psychiatric hold either voluntarily or involuntarily. Question “f” on the ATFE 4473 Firearms Transaction Record states: “Have you ever been adjudicated as a mental defective OR have you even been committed to a mental institution?” In these situations, someone can petition the PSRB and request a hearing to prove to the board that the person is no longer suffering from a mental disease or defect that would pose a threat to the safety of the public or himself or herself. With these types of petitions, it is important to seek out an independent psychological assessment and submit the report with the petition. Character witnesses are also important.
